End User License Agreement

This End User License Agreement (“EULA”) is between you and BuildTrack Pro LLC for the use of the BuildTrack Pro mobile application (“App”) available through the Apple App Store.

1. License Grant

BuildTrack Pro LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, subject to the Usage Rules set forth in the App Store Terms of Service.

2. Scope of License

This license does not allow you to: (a) distribute or make the App available over a network where it could be used by multiple devices at the same time; (b) reverse-engineer, decompile, or disassemble the App; (c) rent, lease, lend, sell, or sublicense the App; (d) copy the App except as expressly permitted by this license.

3. Subscription

The App requires an active BuildTrack Pro subscription. Subscriptions are purchased through buildtrackpro.app and managed through your account settings. The App is a companion to the web-based Service.

4. Consent to Use of Data

You agree that BuildTrack Pro LLC may collect and use technical data and related information, including but not limited to device information, system software, and peripherals, to facilitate software updates, product support, and other services. See our Privacy Policy for full details.

5. Third-Party Services

The App may display, include, or make available content from third parties or provide links to third-party services. You acknowledge that BuildTrack Pro LLC is not responsible for third-party content or services.

6. Warranty Disclaimer

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND. BUILDTRACK PRO LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

7. Limitation of Liability

IN NO EVENT SHALL BUILDTRACK PRO LLC BE LIABLE FOR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES ARISING FROM THE USE OF OR INABILITY TO USE THE APP. TOTAL LIABILITY SHALL NOT EXCEED FIFTY DOLLARS ($50.00).

8. Apple Requirements

This EULA is between you and BuildTrack Pro LLC only, not Apple. Apple has no obligation to furnish maintenance and support services for the App. Apple is not responsible for any product warranties or claims. Apple is not responsible for addressing any claims related to the App or your use of it. Apple and its subsidiaries are third-party beneficiaries of this EULA.
